Workers’ Comp FAQ’s

How much will I get paid per week when I am out of work for a work related injury? 

The maximum amount you can receive under Georgia law is $500 per week.  However, what you actually receive may be less, depending how much you earned on a weekly basis.


Will my workers’ comp injury entitle me to compensation for my pain, suffering and inconvenience?

No.  Georgia law does not allow compensation for pain and suffering.



If I am already seeing a company doctor, do I have the right to get a second opinion? 

Maybe.  However, it would be wise to consult with an attorney before making any decision about switching doctors or getting a second opinion.

What is the first thing I should do after an automobile accident?

Your first order of business is to seek appropriate medical treatment.  Many people do not experience any pain or discomfort immediately after the wreck, but find themselves in excruciating pain a few hours later.  It is usually a good idea to get yourself evaluated by a doctor just to be thorough.



Should I give a statement to the insurance company before I talk to a lawyer?

Absolutely not!  Insurance companies are in the business of making money, and do not have your best interests in mind.  Always, consult with an attorney before you give an innocent statement that the insurance company will try to use against you later.

DUI FAQ’s

I have been charged with DUI.  Can I lose my driving privileges before I am convicted in a criminal court?

Yes!  Most law enforcement officers file a form with the Department of Driver Services which attempts to administratively suspend your license before you even go to court.  You only have 10 days to file a request for a hearing to try to stop the suspension from happening , so it is important to talk with an experienced DUI attorney as soon as possible after your are arrested.


I only blew a .07, but I am still being charged with DUI. Is that legal? 

Yes.  In Georgia, you can be charged with DUI many different ways.  The most common ways are operating a motor vehicle while having a BAC (blood alcohol concentration) over the legal limit (DUI per se), or operating a motor vehicle while you are intoxicated to the extent you are a less safe driver.  This is the scenario where you can be charged with DUI even though you are not over the legal limit.



Will a nolo contendre or no contest plea let me keep my drivers’ license?

No.  A nolo contendre or no contest plea is treated like a conviction, and your license will be suspended.
